Sparrow Insulation and Concrete Coating Service Agreement
Contract and Warranty
This Service Agreement (“Agreement”) is made between Sparrow Insulation & Concrete Coatings LLC (“Contractor”) and the person requesting an estimate also known as the property owner or property manager (“Customer”). By signing below and/or providing the down payment, Customer acknowledges acceptance of the terms of this Agreement.

1. Project Scope
Contractor agrees to provide spray foam insulation and/or concrete coating services as described in the estimate or proposal provided. Work will be performed in a professional manner consistent with industry standards.

2. Deposit, Acceptance & Cancellation Policy

A 50% deposit is required to schedule work. Once the deposit has been made, the project will be scheduled.

The 50% deposit will constitute acceptance and signature of this Agreement, even if no physical signature is obtained. The contract may be emailed to the Customer for signature upon request.

If the Customer cancels the project after deposit is paid, Contractor retains 10% of the total project cost as compensation for time, estimate preparation, scheduling, and lost opportunities. The balance of the deposit (if any) will be refunded within 14 days.

3. Payment Terms

Remaining balance is due upon completion of the project unless otherwise agreed in writing.

Unpaid balances may be subject to collection fees, attorney’s fees, and interest at the maximum rate permitted by law.

In any dispute arising under this Agreement, the prevailing party shall be entitled to recover reasonable attorney’s fees and costs.

4. Spray Foam Insulation Disclaimer & Liability Waiver
Customer acknowledges the following regarding spray foam insulation:

Proper ventilation during installation is required. Occupants and pets must vacate the premises for at least 24 hours (or as directed) after application.

Contractor is not responsible for odors, dust, or temporary discomfort resulting from installation.

Spray foam insulation may reveal pre-existing issues in framing, electrical, plumbing, roofing, or substrate. Contractor is not responsible for correction of these conditions unless specifically included in writing.

Contractor is not liable for condensation, moisture problems, or structural issues resulting from improper HVAC, ventilation, or building design outside of its control.

Contractor’s maximum liability shall not exceed the cost of the contract. Customer waives any claims for incidental, consequential, or punitive damages.

5. Concrete Coatings Warranty – CTI F1 Polyaspartic System
Sparrow Insulation & Concrete Coatings offers a Lifetime Warranty on all interior flooring applications installed with the CTI F1 Polyaspartic System, provided the following condition is met:

The clear coat must be inspected every two (2) years and, if necessary, re-applied.

The cost to the customer will be for the clear coat materials only. Contractor will provide labor at no additional charge.

If this schedule is not followed, the Lifetime Warranty becomes void and only the standard two (2) year material warranty applies.
Warranty Conditions
-
Proper Maintenance – Floors must be cleaned with recommended products (no harsh chemicals).
-
Exclusions – No coverage for misuse, neglect, accidents, structural movement, substrate issues, extreme conditions, or outdoor installations.

Interior Applications Only – Exterior applications are excluded.
-
Non-Transferable – Warranty applies only to the original purchaser.
-
Claims Procedure – Must be submitted in writing with proof of purchase. Contractor reserves the right to inspect before approving any claim.

6. General Warranty & Limitations

Spray foam insulation carries a manufacturer’s product warranty only. Contractor warrants its workmanship for one (1) year from installation.
-
No warranty is made for pre-existing conditions, substrate failure, or damage caused by third parties, accidents, neglect, or improper maintenance.

Exclusions: Normal wear and tear, cracks due to settling, discoloration, and damage caused by misuse or acts of nature are excluded.

7. Liability, Indemnification & Legal Protection
Customer agrees that:

Contractor is not liable for personal injury, property damage, or health claims arising from spray foam or coatings, except to the extent caused by Contractor’s proven gross negligence.

Customer assumes responsibility for ensuring the building is properly ventilated, conditioned, and maintained after installation.

Customer agrees to indemnify and hold harmless Contractor from any third-party claims, damages, or expenses arising from the work performed, except to the extent caused by Contractor’s gross negligence or willful misconduct.

Any disputes shall be governed by the laws of the State of Florida. Venue for disputes will be in the county where services were provided.

Contractor’s maximum liability is strictly limited to the amount paid under this Agreement.

8. Entire Agreement
This Agreement, together with the attached estimate/proposal, constitutes the entire understanding between the parties. Any changes must be in writing and signed (or electronically accepted) by both parties.
If contract work is solicited and signed at Customer’s residence, Customer may have rights under Florida’s 3-day right to cancel law, and Contractor will provide notice of such rights upon request.
Acceptance
By signing below , paying the 50% deposit, or providing written/electronic confirmation, Customer agrees to the terms of this Agreement.
